These Terms of Service ("Terms") govern your access to and use of our website, including all content, features, products, and services offered through it (collectively, the "Services").

Our website is hosted on Shopify, which provides us with the e-commerce platform to sell our products and services to you.

By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Services.

2. Eligibility

By using the Services, you represent that you are at least 18 years of age or the age of majority in your jurisdiction, whichever is higher. If you are under 18, you may only use the Services under the supervision of a parent or legal guardian who agrees to be bound by these Terms.

All product descriptions, prices, and availability are subject to change at any time without prior notice, at our sole discretion. We reserve the right to discontinue any product or limit quantities sold to any person, household, or geographic area.

5. Orders and Payment

5.1 Placing an Order

When you place an order on our website, you are making an offer to purchase. We reserve the right to accept or decline your order at our discretion. Your order is not binding on us until we confirm acceptance by sending you an order confirmation. We must receive and process your payment before we accept your order.

Please review your order carefully before submitting. We may not be able to accommodate cancellation or modification requests after an order has been accepted and dispatched.

5.2 Pricing

All prices displayed on the website are in Indian Rupees (₹) and include applicable Goods and Services Tax (GST) unless otherwise stated. Shipping charges, if any, are calculated and displayed at checkout before payment.

We reserve the right to correct pricing errors. If a product is listed at an incorrect price due to a typographical or system error, we may cancel the order and notify you, even after you have received an order confirmation. In such cases, we will issue a full refund.

5.3 Payment

We accept payments through the methods displayed at checkout. You represent and warrant that you are authorised to use the payment method you select, that the information you provide is accurate, and that the charges will be honoured by your payment provider.

All purchases are for personal or household use only and not for commercial resale.

6. Shipping and Delivery

Please refer to our Shipping Policy for full details on dispatch timelines, delivery estimates, shipping charges, and our process for handling non-delivery or delays.

We currently ship only within India. We do not offer international shipping at this time.

Delivery timelines are estimates only and are not guaranteed. Once a shipment is handed over to the courier partner, we are not responsible for delays caused by the courier, weather, force majeure events, or other circumstances beyond our control.

7. Returns and Refunds

All returns, refunds, exchanges, and cancellations are governed by our Returns and Refund Policy, which forms part of these Terms. By placing an order, you agree to the terms set out in that policy.

8. Intellectual Property

All content on this website — including but not limited to text, images, graphics, logos, illustrations, product names, packaging designs, the Mr. Macha mascot, and the Mr. Macha wordmark — is owned by Macha Labs or its licensors and is protected by applicable intellectual property laws, including the Copyright Act, 1957, the Trade Marks Act, 1999, and other applicable Indian and international laws.

You may not reproduce, distribute, modify, create derivative works from, publicly display, download, store, or transmit any content from this website without our prior written consent. You are granted a limited, non-exclusive, non-transferable licence to access and use the Services for your personal, non-commercial use only.

The Mr. Macha name, logos, product names, and brand identity are trademarks of Macha Labs. Unauthorised use of any trademark displayed on this website is prohibited.

9. User Content and Feedback

If you submit any content to us — including reviews, comments, photographs, suggestions, ideas, or other feedback (collectively, "User Content") — you grant us a perpetual, worldwide, royalty-free, sublicensable licence to use, reproduce, modify, publish, distribute, and display such User Content in any medium and for any purpose, including commercial use and promotion of the Services.

You represent and warrant that you own or have all necessary rights to the User Content you submit, that it does not infringe on any third party's rights, and that it does not contain unlawful, defamatory, obscene, or otherwise objectionable material.

We may, but are not obligated to, monitor, edit, or remove User Content that we determine to be in violation of these Terms or otherwise inappropriate, at our sole discretion.

10. Privacy

All personal information collected through the Services is processed in accordance with our Privacy Policy and applicable Indian data protection laws, including the Digital Personal Data Protection Act, 2023, to the extent it is in force.

Our website is hosted on Shopify. As a result, your data may be stored and processed by Shopify and its service providers. By using the Services, you acknowledge that your information may be transferred to and processed in jurisdictions outside India, in accordance with Shopify's privacy practices.

11. Grievance Redressal

In accordance with the Consumer Protection (E-Commerce) Rules, 2020, we have appointed a Grievance Officer to address consumer complaints relating to products or services purchased through our website.

The Grievance Officer will acknowledge receipt of any complaint within 48 hours and endeavour to resolve it within one month from the date of receipt.

12. Third-Party Links and Tools

The Services may contain links to third-party websites or integrate third-party tools (such as payment gateways, analytics, or social media platforms). These are provided for convenience and are not under our control. We do not endorse, monitor, or accept responsibility for the content, privacy practices, or terms of any third-party website or service.

Your use of third-party tools and websites is at your own risk and subject to those parties' own terms and policies.

13. Relationship with Shopify

Mr. Macha is powered by Shopify, which provides the e-commerce platform on which we operate. However, all purchases made on this website are made directly with Macha Labs. Shopify is not a party to any transaction between you and us.

By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of the sale, including product quality, delivery, or any injury, damage, or loss resulting from purchased products. You expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from your purchases and transactions with Macha Labs.

You may use the Services only for lawful purposes and in accordance with these Terms. You agree not to:

Nothing in these Terms excludes or limits any statutory rights you may have under applicable Indian consumer protection laws, including the Consumer Protection Act, 2019, to the extent that such rights cannot be excluded or limited by agreement.

16. Limitation of Liability

To the fullest extent permitted by applicable law, Macha Labs, its founders, directors, officers, employees, affiliates, agents, contractors, and service providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunity, arising from or in connection with your use of the Services or any product purchased through the Services.

In no event shall our total aggregate liability to you for all claims arising out of or related to the Services or these Terms exceed the amount you paid to us for the specific product or order giving rise to the claim.

This limitation of liability does not apply to liability that cannot be excluded or limited under applicable Indian law.

17. Indemnification

You agree to indemnify, defend, and hold harmless Macha Labs and its founders, directors, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, or expenses (including reasonable legal fees) arising out of or related to your breach of these Terms, your violation of any applicable law or the rights of any third party, or your access to and use of the Services.

18. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles.

Any dispute arising out of or in connection with these Terms or the Services shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra, India.

Nothing in these Terms affects your statutory right to file a complaint with the appropriate Consumer Disputes Redressal Commission under the Consumer Protection Act, 2019.

19. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable by a court of competent jurisdiction, that provision shall be enforced to the maximum extent permitted by law, and the remaining provisions shall continue in full force and effect.

20. Waiver

Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver must be in writing and signed by us to be effective.

21. Entire Agreement

These Terms, together with our Privacy Policy and Returns and Refund Policy, constitute the entire agreement between you and Macha Labs with respect to the Services and supersede all prior or contemporaneous agreements, communications, and proposals, whether oral or written.
